Claim for compensation under Israeli Aviation Services Law and common law for canceled flight Tel Aviv to Toronto on 16 June 2018

To whom it may concern:
I hereby claim compensation of NIS $3,000 under Israeli law for delayed flight 85 from Tel Aviv on 16 June 2018 under Israel’s Aviation Services Law. See http://www.tourism-law.co.il/pdf/AviationServicesLawENG.pdf.

Flight 85 from Tel Aviv to Canada was canceled due to a failed hydraulic pump in one engine. Air Canada had to wait for replace parts from Canada, which arrived on the next morning's plane.

I also claim additional compensation of at least NIS 3,000 for the damages due to the treatment and suffering caused to myself by the inefficiency and incompetence of Air Canada representative in the hours after the flight.

Air Canada's chaotic handling of its passengers while they organized accommodation and transport to that accommodation is inexcusable. Most passengers were kept waiting standing without seating and communication in 41 degree (Celsius) temperatures in a noisy bus pickup zone for over 2 hours. Water was eventually supplied after some time while the passengers including myself were standing around. I and other passengers could not leave the waiting area as we were not told when transport was coming.

Most passengers including myself had nothing to eat from early morning till they got to their hotels in the evening. Many elderly such as myself, I am 77, and unwell passengers such as those with diabetes suffered.

However the delay in getting buses seemed to be incredible. It seemed that the same bus was making round trips of one hour each to and from Tel Aviv. There were plenty of mini buses and taxis around that could have been used to shuttle passengers to accommodation.

The reception staff at the hotel where Air Canada found accommodation for me told me that the rooms were ready from about 3.00 pm, which was about one hour after deplaning.

Your pathetic offer of a discount made to some other passengers off future Air Canada flights is unacceptable as I have no plans to fly. Please do not waste your time and mine by making a similar offer to me.

Should I not receive a satisfactory response from Air Canada, my plans are as follows.

1. Contact the press to publicize this and other passenger’s claims.
2. Engage an Israeli law firm to initiate a claim in the Israeli courts for a NIS 3,000.00 claim under Israel’s Aviation Services Law. I shall also contact many of the other passengers to do a group or class claim. This will undoubtable be both legally costly and bad publicity for Air Canada. You could even have one of your planes attached by the Israeli courts.
3. Institute an additional claim for damages in Israel for pain and suffering due to Air Canada negligence, again together with other passengers.

Please let us settle this fairly and simply and avoid a great deal more loss for Air Canada.
